Notwithstanding section, a peace officer, as defined in section , subdivision 1, paragraph (c), who is on or off duty within the jurisdiction of the appointing authority or on duty outside the jurisdiction of the appointing authority pursuant to section , may arrest a person without a warrant if the peace officer has probable cause to believe that the person within the preceding four hours has committed a fifth-degree assault, as defined in section , on school property, as defined in section , subdivision 1d. The arrest may be made even though the crimes were not committed in the presence of the peace officer.
